§ 66-21. Authority and intent.

  • (a)

    This article is authorized pursuant to Fla. Const. art. VIII, § 2(b), the village's home rule powers, F.S. ch. 166, 33 U.S.C. § 2718 of the Oil Pollution Act of 1990, F.S. § 376.19 of the Pollution Discharge Prevention and Control Act and Chapter 2000-408, Laws of Florida.

    (b)

    Pursuant to Fla. Const. art. VIII, § 2, F.S. ch. 166 and the village's home rule authority, the village is authorized to create an ordinance not inconsistent with general or special law.

    (c)

    It is the intent of the village to exercise local authority to supplement federal and state law with regard to the regulation of the discharge of oil, or other pollution by oil, or removal activities in connection with such a discharge, by providing an additional mechanism for regulation of oil pollution, or other pollution by oil, and for recovery of costs, expenses, and fees related to removal or remediation in connection with such a discharge of oil.
