§ 50-1. Overnight camping.

  • (a)

    No person may camp within the right-of-way of U.S. 1 in the village between the hours of 11:00 p.m. and 6:00 a.m. For the purposes of this section, the placement of a tent or parking of a recreational vehicle as defined in F.S. § 320.01(1)(b) on the right-of-way of U.S. 1 during the hours designated in this subsection shall be presumed to constitute camping.

    (b)

    No person may camp within the right-of-way of any arterial or collector street maintained by the village between the hours of 11:00 p.m. and 6:00 a.m. For the purposes of this section, the placement of a tent or parking of a recreational vehicle as defined in F.S. § 320.01(12)(b) on the right-of-way of any of the streets described during the hours designated in this subsection shall be presumed to constitute camping.

    (c)

    Signs shall be placed prominently as to be clearly noticeable at the north and south borders of the village and at any other location as deemed necessary by the village manager. The words "No camping on Village right-of-way or on U.S. 1 right-of-way between the hours of 11:00 p.m. and 6:00 a.m. by order of Village Ordinance No. 99-06" shall appear in letters of not less than two inches in height.

    (d)

    Any violations of this section may be enforced by the village by any means authorized by law, including, but not limited to, a code enforcement notice of violation, a code enforcement civil citation, a summons, a notice to appear in the county court, an arrest or a civil action for injunctive relief. The enforcement procedures outlined in this subsection are cumulative to all others and shall not be deemed to be prerequisites to filing suit for the enforcement of any part of this section.
