§ 26-48. Penalties.

The following penalties shall apply:

(a)

Any person, firm or corporation, or any agent thereof, who violates any provision of this article may be subject to criminal sanction in accordance with F.S. ch. 791. Each violation of this article constitutes a separate offense and is punishable as such.

(b)

The primary responsibility for the enforcement of this article lies with the fire chief or designee.

(c)

Nothing in this article shall prevent the village from bringing a civil action or imposing civil penalties upon a violator in an appropriate case.

(d)

Any law enforcement officer shall seize, take, remove or cause to be removed at the expense of the owner all stocks of fireworks offered or exposed for sale, stored or held in violation of F.S. ch. 791.
