§ 26-33. Authority and duties of standby fire watch personnel.

  • (a)

    Fire rescue personnel assigned to the fire watch shall be subject to the fire chief's orders at all times when so engaged, and shall remain on duty during the time such places are open to the public, or while such activity is being conducted. Fire rescue personnel shall not be under the direction or supervision of the party or person requesting and/or paying for such fire watch. For purposes of worker's compensation insurance and to ensure the safety of the general public, the fire rescue personnel shall act under the direction and control of the fire chief and while so acting shall be deemed employees of the village and entitled to receive compensation from the village in accordance with F.S. ch. 440.

    (b)

    Before each performance or the start of each activity, the fire rescue personnel assigned to the fire watch shall inspect all required fire/life safety equipment to ensure that such equipment is in proper working order, and shall keep diligent watch for any emergency that may arise.

    (c)

    Should an emergency arise, the fire rescue personnel shall take whatever action is necessary to protect the occupants and public from injury or any life-threatening condition, and shall otherwise be subject only to the direction and control of the fire chief.
